TERMS OF USE

1.1. The terms and conditions apply to the legal relationships that arise between the customer (hereinafter the Client) and Ariol Trading OÜ (hereinafter the Seller), the owner of the shopping environment located at the internet address arioltrading.ee (hereinafter the E-shop) in connection with the purchase of Products from the E-shop. In addition to these terms and conditions, the legal relationships arising from the purchase of Products from the E-shop are governed by the legislation in force in the Republic of Estonia.

Prices
2.1 All prices displayed in the E-shop are presented in euros and include VAT.

Products
3.1. As a rule, the Products displayed in the e-shop are available in stock. The availability of said Products is not guaranteed, as it may be erroneous due to possible technical problems in the E-shop programs.

Making a purchase
4.1. The customer selects the desired Product in the E-shop and adds it to the shopping cart by clicking the "Add to cart" button.
4.2. To complete the order, click on the "Continue to pay" button in the shopping cart, after which the Customer will be redirected to the order completion page. After entering the required data, the Customer pays for the Product via the bank link of the online bank and confirms the order by clicking the "Back to merchant" button.
4.3. After paying for the Product, the E-shop sends an order confirmation to the Customer's e-mail.
4.4. When completing the order, the customer undertakes to provide the necessary, true data to fulfill the order.
4.5. The Seller is not responsible for the impossibility of execution due to incorrect data provided by the Customer or any resulting consequences.

Payment methods
5.1. You can safely pay for orders using Estonian bank links: Swedbank, SEB Bank, Nordea Bank or by bank transfer.
5.2. The payment is made outside the E-shop environment in the secure payment environment of the respective bank or service provider.
5.3. The seller does not have access to the Customer's bank details.

Delivery
6.1. The customer can choose between different ways of delivering the Product. The delivery of the product depends on the postal service chosen by the Customer and depending on the delivery time of the product, which is displayed when creating the order.
6.2. By choosing an Omniva parcel machine, an Itella SmartPost parcel machine as the delivery method, the Product will arrive at the parcel machine selected by the Customer within 5 working days from the order confirmation being sent to the Customer's e-mail address.
The Customer will be notified of the product's arrival at the parcel machine with an SMS message containing the door code, the location of the parcel machine and the end of the storage period. You can see the opening time of the machines on their website. The product is stored in the parcel machine for 7 calendar days. After the end of the specified term, the Product will be returned to the E-shop.
6.3. The customer is obliged to keep in clause 6.2. said SMS message until the end of the 14-day return period.
6.4. By choosing a post office as the delivery method, the Product will arrive at the post office selected by the Customer within 5 working days from the order confirmation being sent to the Customer's e-mail address. When the Product arrives at the post office, the Customer will be notified with an SMS message that contains information about the post office where the Customer can pick up the Product. The product is kept at the post office for 14 calendar days. After the end of the specified term, the Product will be returned to the E-shop.
6.5. By choosing Courier as the delivery method, the Product will arrive at the address chosen by the Customer within 5 working days from the order confirmation being sent to the Customer's e-mail address. The courier contacts the Customer by phone and coordinates a suitable time for delivery. In the event of an unsuccessful delivery attempt, the parcel will be stored at the post office at the place of residence, and the Customer will be notified of the arrival of the postal shipment by e-mail to the Customer's e-mail address, or by simple letter to the mailbox. The product is kept at the post office for 14 calendar days. In the event that the Customer does not pick up the Product within the aforementioned deadline, the Customer is obliged to compensate the costs related to repeated shipping.
6.6. If the Customer has completed the order on a weekend (between Friday after 1:00 p.m. and Monday until 9:00 a.m.) or on a national holiday, the 5-day deadline will begin at 9:00 a.m. on the first working day following the weekend or national holiday.
6.7. The customer is obliged to check the correctness of the contact information provided before placing the order, in order to avoid delays and misunderstandings in the delivery of the Products. The Seller is not responsible for delays and misunderstandings in the delivery of the Products, if the delay or misunderstanding is due to the inaccuracy or incorrectness of the data provided by the Customer when placing the order.
6.8. In the event that the Product does not reach the Customer in good condition and in a closed package, the Customer is obliged to inform the E-shop immediately by sending a corresponding letter to the e-mail address: ariol.trading@gmail.com.

Product exchange and return
7.1 The customer is obliged to keep the sales package, invoice and delivery note. In the event of problems, the customer forwards the goods to the seller in the original packaging along with documents and a return form.
7.2. The customer has the right to withdraw from the transaction within 14 days and exchange or return the ordered Product. The mentioned 14-day period starts from the receipt of the notification of arrival of the Product at the selected parcel machine or post office, and in the case of a courier, from the arrival of the Product at the Customer's address.
7.3. The customer is obliged to first inform the e-shop by submitting a corresponding written return form to the seller and sending the e-mail to ariol.trading@gmail.com. Together with the return form, the buyer also returns the goods to the seller. The product will be returned to the e-shop within 5 working days. The E-shop sends a confirmation to the Customer's e-mail about the receipt of the product.
The e-store's customer support is responsible for the exchange or return process of the Product according to the e-store's return conditions.
7.4. The Customer can return the Product to any store belonging to the Seller. The customer service representatives of these stores forward the Product to the E-shop, where the Product exchange or return process is carried out. The product arrives at the E-shop within 5 working days. The E-shop sends a confirmation to the Customer's e-mail about the receipt of the product.
7.5. The shipping costs associated with the return if using a parcel machine or post office are covered by the Buyer.
7.6. In the event of an exchange, the E-shop will send a new Product to the Customer immediately after receiving the Product to be exchanged.
7.7. The product can only be exchanged for another product within the purchased amount, if the same product is not available from the seller.
7.8. The Seller will return the purchase amount to the Customer within 14 days from the timely arrival of the Product in the E-shop. The return is made to the same current account from which the Customer paid for the returned order.
7.9. In case of a refund of the purchase amount, the Seller will not reimburse the Customer for the cost of the transport service related to the relevant purchase.
7.10. When exchanging or returning the Product, the Customer is obliged to fill out the exchange and return form that came with the Product and send it to the E-shop together with the Product to be exchanged or returned.

7.11. The Product to be exchanged or returned must not be damaged or have signs of wear, the Product must be in its original packaging and all original labels must be attached to the Product. Goods that have been opened from the package will not be returned for hygienic reasons.
7.12. The customer is obliged to always open the Product packaging carefully, without damaging it. If it is not possible to open the package without damaging it, returning the Product in the original package is not required.

Procedure for submitting claims
8.1. Products sold in the e-shop are subject to the 2-year claim submission deadline stipulated in Section 218, subsection 2 of the Tax Code. Disagreements between the customer and the seller will be resolved through negotiations.
8.2. Pursuant to the provisions of § 222 (1) of the Law of Obligations Act, the Customer has the right to demand repair or replacement of the Product if the Product does not comply with the contractual conditions. In the event of non-compliance of the Product with the contractual conditions, the costs related to the repair of the Product or the replacement of the Product, in particular transport, postage, labor and material costs, shall be borne by the Seller.
8.3. The Seller is not responsible for damages caused by the non-intended use of the ordered products, as well as for delivery delays, if this is due to circumstances beyond the Seller's control and/or due to force majeure beyond his control.

Responsibility
9.1. The seller and the customer are responsible to each other for the damage caused to the other party by violating these terms of use in the cases and to the extent provided by the legislation in force in the Republic of Estonia.
9.2. The seller is responsible to the extent of the sale price of the Product
9.3. The customer undertakes to use the E-shop service only for purposes consistent with the law and good practices.

Privacy Policy
10.1. The Customer gives the Seller clear and informed consent to the processing of his personal data.
10.2. The personal data made known to the seller are entered into the customer register and are used to provide sales services and offer goods to the customer.
10.3 The Seller stores the contact details and information about the purchases made by the Customer in the course of making purchases. This information is treated as confidential and processed in accordance with the Personal Data Protection Act. Personal data, which are necessary to send the Products to the Customer, are transferred to the company providing the courier service.
10.4. The Seller may use the Customer's personal data to send the Customer information about special offers and campaigns by e-mail only if the Customer has given his consent.
10.5. Data communication between the Client and the banks and the card payment center is encrypted, which ensures the security of the Client's personal data and bank data.
The payment is made outside the E-shop environment, in the secure payment environment of the respective bank or service provider. The e-shop does not have access to the Customer's bank details and credit card details.

Terms of Use and their modification
11.1. By registering in the e-store or making a purchase, the Customer accepts the terms of use of the e-store and undertakes to comply with them.
11.2. The sales contract between the Seller and the Customer enters into force from the receipt of the payable purchase amount to the Seller's current account.
11.3. The seller can change the terms of use of the E-shop and the prices of the products. Notice of changes will be published in the E-shop environment. The conditions and prices valid at the time of the transaction are applied to the transaction.
11.4. The seller has the right to cancel the order if the price of the Product displayed in the E-shop was incorrect due to a technical error.

Other conditions
12.1. Disagreements between the customer and the seller will be resolved through negotiations. In case of failure to reach an agreement, the Customer has the right to appeal to the Harju County Court, the Consumer Protection Board and/or the Consumer Complaints Commission for the protection of their rights.

Please note before placing your order
Buying contact lenses
A. Visit a competent ophthalmologist or optometrist, who will determine whether and which contact lenses are right for you (in the future, visit a doctor or optometrist at least once a year). If you have a valid lens prescription or know exactly which contact lenses are right for you, place an order according to your lens parameters.
B. Select the appropriate item. When ordering contact lenses, indicate the strength of the contact lens in diopters (Sph);
C. When ordering contact lenses, please note that they can be ordered as a single pair or as a box. If the power of the contact lenses of the buyer's right eye (OD) and left eye (OS) are different, two boxes must be ordered, i.e. one box for each eye;
D. Make sure the contents of the shopping cart are correct - does it still meet your wishes? Pay attention to the contact lens data;
